Board of Governors' Resolution Against Iran Lacks Legal Validity

TEHRAN (Defapress) - Hossein Noushabadi, the Parliamentary Director General of the Ministry of Foreign Affairs and a former member of the National Security and Foreign Policy Commission of the Parliament, in an interview with the political correspondent of Defense Press, in response to the resolution of the Board of Governors of the International Atomic Energy Agency and the re-referral of the Iranian nuclear file to the United Nations Security Council, stated: This resolution, which was approved at the suggestion of the United States and the European group and accuses Iran of not adhering to its obligations within the framework of the Treaty on the Non-Proliferation of Nuclear Weapons (NPT) and the provisions of the JCPOA, is fundamentally devoid of legal validity and contrary to the duties and missions of the International Atomic Energy Agency.

He added: The claim that the Agency does not have access to Iran's nuclear facilities and the approval of the resolution to refer our country's nuclear file to the Security Council has fundamentally no technical or legal basis and is merely a political move by the United States, Britain, France and Germany to pressure the Islamic Republic of Iran, gain concessions and get rid of the impasse that the United States has faced in the region.

Referring to the claim made about Iran preventing IAEA inspectors from accessing the country's nuclear facilities, Noushabadi stated: "The conditions created in this regard are the result of the military aggression of the United States and the Zionist regime and the bombing of Iran's nuclear facilities, and this fact cannot be ignored."

He continued: "Instead of condemning the illegal attacks of the United States and the Zionist regime on Iran's nuclear facilities and fulfilling its inherent and legal duties, the Agency has proceeded to prepare reports that lack the necessary legal and specialized basis and has practically provided an excuse to countries that have a long-standing enmity with the Islamic Republic of Iran."

The Parliamentary Director General of the Ministry of Foreign Affairs said: "Unfortunately, the Board of Governors has become a tool for abuse by countries that have violated the fundamental principles of international law, the United Nations Charter, and nuclear safety and security standards by attacking nuclear facilities under Iranian safeguards."

Noushabadi considered the IAEA's decision to send the Iranian nuclear file to the Security Council a biased and political move, and stated: "Such an approach degrades the status of the IAEA from a specialized and independent institution to a political institution that is a tool in the hands of others."

He criticized the lack of a decisive response from the IAEA member states and the presidency of this institution to the attacks by the United States and the Zionist regime against Iran's nuclear facilities, saying: "It is regrettable that the illegal actions of the United States and Israel have not yet met with a collective and worthy response from the IAEA member states and a decisive condemnation from the presidency of this institution."

Noushabadi added: "The IAEA report should have noted that the attacks by the United States and the Zionist regime on Iran's nuclear facilities were the main reason for Iran's refusal to grant access to some facilities, not another issue."

Stating that the Agency's reports ignored Iran's peaceful nuclear program and our country's cooperation with this institution, he said: "Also, the consequences of the military aggression of the United States and the Zionist regime against nuclear facilities under safeguards were not taken into account, and ultimately, a resolution was issued against Iran."

The Parliamentary Director General of the Ministry of Foreign Affairs emphasized: "The United Nations Security Council, in accordance with its competences and mission in the field of maintaining international peace and security, is expected to examine the resolution itself, as well as the causes and root causes of the current situation regarding the implementation of safeguards in the Islamic Republic of Iran."

He noted: "The Security Council must consider the direct consequences of the unjustified and unjustified aggressions of the United States and the Zionist regime against Iran's nuclear facilities under Agency safeguards; especially since these facilities have been targeted and bombed several times over the past year."

Noushabadi considered the credibility of the International Atomic Energy Agency dependent on its impartiality, independence, and technical nature, and said: If the Agency is indifferent to these duties and adopts a biased, non-specialized, and non-independent approach, it will lose its credibility in the international system and become a plaything for the greed of aggressive and adventurous countries.
